Surety Bond Requirements

Requirements for Wyoming ESA Education Service Providers to file a surety bond when receiving or expecting to receive over $150,000 in annual ESA funds.

Who Must File a Surety Bond?

Education Service Providers (ESPs) that receive or expect to receive more than $150,000 annually in Wyoming ESA funds are required to file a surety bond.

Why Is a Surety Bond Required?

The surety bond protects ESA students and the program against financial loss if an ESP fails to deliver services for which they have already received payment, or if they misuse ESA funds.

Consequences of Non-Compliance

Failure to secure a required surety bond may result in the suspension and disqualification of the ESP from the Wyoming ESA program. ESPs should ensure they file the required bond before reaching the $150,000 funding threshold.
