Participation in the ESA program is a parental placement under the Individuals with Disabilities Act (IDEA). School districts are not obligated to provide that student with a free appropriate public education (FAPE). ESA students may be entitled to special education services provided by their local school district under Part B of IDEA. To receive those services, they must have a need identified in a current Individualized Education Plan (IEP) or receive an evaluation from their district. Parents or guardians may contact their local school district's special education department or Parentally Privately Placed office for more information on how to request an evaluation and access special education services for a student who does not attend public school. Evaluations completed by a private, licensed provider may also be provided to the district.
